By what authority?

I thought things were bad when Congress considered bailing out the big domestic automakers.

Then the effort stalls in the Senate. Now, the president, the frigging president, is planning on moving ahead with some sort of bailout for them anyway, as though the approval of Congress were a pointless superfluity.  

Do either Congress or the president recognize any limitation on their power? If so, what?

Is the judiciary the only branch of the federal government that keeps a copy of the Constitution handy? Or will we find out, if the president declines to act, that the Supreme Court already has it’s own Big 2.5 Bailout plan at the ready?
